A Taylorsville Justice Court Judge named Michael Kwan has reportedly been suspended from his post for six consecutive months without pay. The decision was made by the state Judicial Conduct Commission (JCC) after they found that Kwan had participated in “long-winded rants against President Trump and Republicans, not only on social media but right in his courtroom as well. If he should repeat this behavior, he will be barred from the bench forever. He has a nasty habit of calling the president and other Republicans Nazis, which is a lie since it’s the Democrats who hate Jews and the Republicans who defend them. It is Rashida Tlaib and Ilhan Omar who raise money for terrorists who want to kill Jews, not Republicans,” according to DavidHarrisJr.com.

The Daily Caller reports that Utah Supreme Court Justice John Pearce wrote out his opinion, supporting the sanctions against Judge Kwan. Pearce stated, “Fulfillment of judicial duties does not come without personal sacrifice of some opportunities and privileges available to the public at large. And as a person the public entrusts to decide issues with the utmost fairness, independence, and impartiality, a judge must at times set aside the power of his or her voice.”

The state Judicial Conduct Commission (JCC) brought formal charges against Kwan after the judge disparaged the president on social networks and in his own courtroom during official proceedings. In one social media post, for example, Kwan suggested that congressional Republicans were comparable to the rubber-stamp parliament of Nazi Germany.

“Welcome to the beginning of the fascist takeover,” wrote Kwan. “We need to be diligent in questioning congressional Republicans if they are going to be the American Reichstag and refuse to stand up for the Constitution, refuse to uphold their oath of office, and enable the tyrants to consolidate their power.”

Judge Kwan faced an investigation for comments he made in 2017 that the Court said appeared to demean a defendant and President Trump.

“And I did not call, but I plan on when I get my taxes to just pay off all my court fines, because I cannot end up in jail again for not complying,” the defendant said.

“You do realize that we have a new president, and you think we are getting any money back?” Judge Kwan replied, according to the transcript.

“I hope.”

“You hope?”

“I pray and I cross my finger.”

“Ok. Prayer might be the answer. ‘Cause, he just signed an order to start building the wall and he has no money to do that, and so if you think you are going to get taxes back this year, uh-yeah, maybe, maybe not. But don’t worry[,] there is a tax cut for the wealthy so if you make over $500,000 you’re getting a tax cut. You’re right[] there[,] right? Pretty close? All[]right, so do you have a plan? Other than just get the tax cut and pay it off?” the judge replied.

The judge previously faced discipline for yelling at a court clerk and, the Utah Supreme Court said, posted repeatedly on social media about Trump during the 2016 election cycle.

“With respect to Donald Trump, Judge Kwan’s postings were laden with blunt, and sometimes indelicate, criticism,” the Court wrote.

Judge Kwan has resisted disciplinary efforts, insisting they are protected by the First Amendment and his comments leading up to the presidential election are largely “social commentary or humor.”
